A deceased Navy member's son requested a review of his claim for arrears of military retired pay that were owed but never paid to his father, and survivors' benefits, if any, owed to his mother. GAO held that the claimant was improperly barred from claiming the decedent's withheld retired military pay, since no statue of limitation existed regarding such claims for trust funds established for undeliverable pay due to the designation of an employees' place of residence as a restricted country. Accordingly, the claim was remanded to the Navy, and GAO recommended that the Navy ascertain: (1) the allowable amounts, if any, that were withheld; and (2) whether the claimant was the legal beneficiary of the funds.
