This responds to your letter of December 13, 1989, requesting our comments on Federal Acquisition Regulation (FAR) case No. 89-78, a proposal that would prescribe new solicitation provisions for negotiated construction contracts.

Under the proposed changes, the Contract Award provision at FAR section 52.215-16 would be revised to include an alternate paragraph (d) that would allow the government to accept any item or combination of items, unless otherwise precluded from doing so by the terms of either the solicitation or the offer. A new solicitation provision at FAR section 52.215-39, Preparation of Offers - Construction, would require offers to be submitted on prescribed forms. These forms could require prices on various bases, such as lump sum or units of construction. FAR section 15.407 would be revised to prescribe the use of these solicitation provisions.
