The Departments of the Air Force and the Army requested a decision regarding whether two retired military officers holding civilian positions were subject to the Dual Compensation Act of 1964, contending that both officers improperly received full retirement pay while employed by the federal government. GAO held that: (1) dual compensation provisions were applicable to the officers; (2) the Army and the Air Force should reduce the claimants' retired pay; and (3) the Air Force could waive one claimant's indebtedness. Accordingly, dual compensation prohibitions were applicable.
