The Administrative Office of the U.S. Courts requested a decision regarding a transferred employee's claim for reimbursement for temporary quarters subsistence expenses associated with his occupancy of a rental residence he owned at the new station. The claimant contended that he was entitled to such reimbursement, since he: (1) had listed the residence for sale because of its unsuitability for his children; and (2) intended to purchase another residence as soon as he sold the rental residence. GAO held that the claimant failed to clearly establish his use of the residence as temporary quarters. Accordingly, the claim was denied.
