PROCUREMENT - Bid Protests - GAO procedures - Protest timeliness - 10 day rule DIGEST: Protest of the cancellation of a solicitation filed more than 8 months after protester knew of the cancellation is untimely.

BarbeePardo Architects:

BarbeePardo Architects protest the cancellation of request for proposals (RFP) No. GS-07-P-87-HU-C-0025/7PPC issued by the General Services Administration (GSA) for architect-engineer services. BarbeePardo also requests payment for its proposal preparation costs.

GSA canceled the solicitation by letter dated August 7, 1987, because funding for the project was withdrawn. BarbeePardo filed its protest to this Office on April 19, 1988, more than 8 months later. Accordingly, the protest is untimely, since it was filed more than 10 days after BarbeePardo knew the basis of its protest. 4 C.F.R. Sec. 21.2(a)(2) (1988).

Regarding BarbeePardo's monetary claim, we will not consider a claim for bid preparation costs which is submitted in connection with an untimely protest. Gudenau and Co., Inc., B-226081, Feb. 2, 1987, 87-1 CPD Para. 106.

The protest and the claim are dismissed.
