An Occupational Safety and Health Administration employee appealed the denial of his claim for backpay for a period of time in which he performed the duties of a higher-grade-level position. GAO held that the claimant was not entitled to backpay, since: (1) the claimant filed the claim after the 6-year statutory limitation; and (2) it did not have the authority to waive the limitation. Accordingly, the claim was denied.
