DIGEST: While General Accounting Office has no objection to proposed change to FAR SEC. 3.103-2 instructing contracting officers to report offers from foreign suppliers for overseas requirements suspected of being collusive or containing false certificates of independent pricing, it suggests that FAR Sec. 3.103-l(b) pertaining to the certificate be modified to conform to the new requirement.

This responds to your request for our comments on a proposal to amend Federal Acquisition Regulation (FAR) Sec. 3.103-2, which concerns the process for evaluating certificates of independent price determination, and reporting offers suspected of being collusive or containing false certificates. This is FAR Case No. 87-46.

The proposed change would instruct contracting officers to report offers suspected of being collusive or containing false certificates in accordance with overseas contracting activity instructions when the offers are from foreign suppliers for overseas requirements. While we have no objection to the proposed change, we note that FAR Sec. 3.103 l(b) also requires modification because it presently exempts solicitations for work to be performed overseas by foreign suppliers from coverage under the FAR provisions relating to certificates of independent price determination.
