The Nuclear Regulatory Commission (NRC) requested a decision concerning: (1) an employee's claim for reimbursement for the costs he incurred in transporting his household goods; and (2) whether it should refer the claim to Congress for consideration under the Meritorious Claims Act. GAO held that the: (1) employee was not entitled to reimbursement, since his position was not a designated manpower-shortage position; and (2) claim was not appropriate for submission under the act, since NRC had informed the claimant that it had given him erroneous information concerning his entitlement prior to his acceptance of employment. Accordingly, NRC should not reimburse the claimant.
