[Request for Remission of Air Force Assessment of Liquidated Damages]

A firm requested the remission of liquidated damages that the Air Force assessed because of inadequate contract performance. GAO held that: (1) it would not remit the damages in the absence of a favorable recommendation from the Air Force; and (2) the Air Force recommended denial because of inordinate delays in contract performance. Accordingly, the request was denied.
