The Forest Service requested reconsideration of a recommendation GAO made in its denial of a protest of the Service's contract award for data recorders. GAO had recommended that the Service solicit separately for an upgraded model rather than exercise an option in the awardee's contract. In its request for reconsideration, the Service contended that: (1) one of the offerers did not intend to bid under the new procurement, since it could not develop the required enhancements; and (2) conducting a new procurement would unfairly disclose the awardee's technical information. GAO held that the Service failed to: (1) show any factual or legal error in the original decision; (2) demonstrate that a prospective offerer could not offer the required model; or (3) show that the awardee would be at a disadvantage. Accordingly, the original decision was affirmed.
