The Army requested an advance decision concerning whether it should grant exemptions from dual compensation restrictions to four retired military officers holding civilian positions with certain government agencies. GAO held that retired military personnel employed by the: (1) Federal Reserve Board were exempt from the dual compensation restrictions, since the Board was a nonappropriated fund instrumentality; and (2) Department of Energy's Office of Civilian Radioactive Waste Management were not exempt, since the Office used appropriated funds. Accordingly, the Army should refund the amount it deducted from the pay of those retirees employed by the Federal Reserve Board, subject to the 6-year statutory limitation.
