THIS IS TO ADVISE YOU THAT WE ARE CLOSING OUR FILES ON THE ABOVE NUMBERED PROTESTS CONCERNING THE ISSUANCE OF FOUR DELIVERY ORDERS BY THE DEPARTMENT OF THE ARMY, WATERVLIET ARSENAL, WATERVLIET, NEW YORK.

IN YOUR INITIAL PROTESTS, WHICH WERE FILED ON NOVEMBER 13, 1985 AND WHICH ARE IDENTICAL EXCEPT FOR THE DELIVERY ORDER NUMBERS, /1/ YOU REQUESTED A CONFERENCE. AFTER AT LEAST TWO UNSUCCESSFUL ATTEMPTS TO REACH YOU BY TELEPHONE (YOU DID NOT RETURN THE STAFF ATTORNEY'S CALLS), WE ADVISED YOU BY WRITTEN NOTICE DATED NOVEMBER 26 THAT WE HAD SCHEDULED THE CONFERENCE AT OUR OFFICE AT 10 A.M. ON DECEMBER 30. WHILE REPRESENTATIVES OF THE ARMY MATERIEL COMMAND, THE PROCURING AGENCY, AND OF INFORMATION HANDLING SERVICES, INC., AN INTERESTED PARTY, WERE PRESENT AT THE SCHEDULED TIME, YOU DID NOT ATTEND OR OTHERWISE ADVISE US THAT YOU WERE UNABLE TO DO SO.

NOR HAS YOUR FIRM COMMENTED ON THE PROCURING AGENCY'S REPORT WITHIN THE 7 WORKING DAYS THAT ARE ALLOWED FOLLOWING RECEIPT OF THE REPORT IF A CONFERENCE IS NOT SCHEDULED. WE RECEIVED THE REPORT ON DECEMBER 20, AND, AS OUR ACKNOWLEDGMENT ADVISED YOU, WE ASSUMED THAT YOU RECEIVED YOUR COPY AT THE SAME TIME. UNDER OUR BID PROTEST REGULATIONS, YOUR COMMENTS WERE DUE BY CLOSE OF BUSINESS ON JANUARY 2; WE HAVE NOT YET RECEIVED THEM. BASED ON YOUR FAILURE EITHER TO ATTEND THE CONFERENCE OR TO FILE COMMENTS ON THE AGENCY REPORT, WE REGARD YOUR PROTEST AS ABANDONED. THEREFORE, AS NOTED ABOVE, WE ARE CLOSING OUR FILES WITHOUT ACTION.
