UNITED TELECONTROL ELECTRONICS, INC.:

UNITED TELECONTROL ELECTRONICS, INC. (UTE), PROTESTS A CONTRACT ALLEGEDLY AWARDED ON MAY 30, 1985, BY THE UNITED STATES ARMY COMMUNICATIONS- ELECTRONICS COMMAND (CECOM) UNDER INVITATION FOR BIDS (IFB) NO. DAAB07-85- B-H065 FOR THE SUPPLY OF 201 BATTERY CHARGERS. THE PROTESTER CONTENDS THAT IT WOULD BE MORE COST EFFECTIVE FOR CECOM TO EXERCISE AN OPTION UNDER IFB NO. DAAB07-84-B-0308, WHERE IT IS THE LOW BIDDER, THAN TO BUY THESE ITEMS FROM ANOTHER COMPANY. UTE ALLEGES THAT THE COST TO THE GOVERNMENT UNDER THE MAY 30, 1985, CONTRACT AWARD IS $3,800 PER UNIT COMPARED TO $3,515.45 PER UNIT UNDER THE OPTION PROVISION OF IFB NO. DAAB07-84-B- 0308.

INITIALLY, WE NOTE THAT NO AWARD HAS BEEN MADE UNDER SOLICITATION NO. DAAB07-84-B-0308, WHICH IS THE SUBJECT OF A PROTEST (B-218482) FILED IN OUR OFFICE BY ANOTHER FIRM AGAINST AN AWARD TO UTE.

FURTHER, UNDER OUR BID PROTEST REGULATIONS, A PROTEST MUST CONTAIN A DETAILED STATEMENT OF THE LEGAL AND FACTUAL GROUNDS FOR PROTEST, COPIES OF ANY RELEVANT DOCUMENTS AND STATE THE RELIEF REQUESTED. SEE 4 C.F.R. SECS. 21.1(C)(4) AND 21.1(C)(6) (1985). UTE'S TELEGRAM OF JUNE 3, 1985, WHICH ESSENTIALLY ARGUES THAT THE GOVERNMENT SHOULD EXERCISE AN OPTION UNDER A CONTRACT WHICH HAS NOT YET BEEN AWARDED, IS INSUFFICIENT TO CONSTITUTE A DETAILED STATEMENT OF LEGAL AND FACTUAL GROUNDS FOR PROTEST.

ACCORDINGLY, THE PROTEST IS DISMISSED.
