[Response to Request for Decision Concerning Entitlement of Seasonal Forest Service Employees to Per Diem]

The Forest Service requested a decision as to whether 11 seasonal employees were entitled to per diem expenses for a 3-month assignment at a seasonal worksite. The employees contended that: (1) their seasonal duty station was not their official duty station; and (2) since their 3-month seasonal assignment was temporary, they were entitled to per diem for that period. The Service contended that the new duty station was the employees' official duty station under its regulations, which provided that any assignments away from the official station planned to exceed 2 weeks at one location constituted reassignment. GAO found that: (1) the employees were subject to the regulations; and (2) the new duty station was their official duty station since they performed the assignment at that station for more than 2 weeks. Accordingly, the claims were denied.
