A firm requested reconsideration of a decision which dismissed as untimely its protest alleging that the specifications in a Navy solicitation were ambiguous. Its bases for reconsideration were that the Navy failed to provide review copies of the solicitation before the preproposal conference and that it had protested to the Navy by telephone and telex before the bid closing date. GAO will not reconsider a protest that does not challenge the facts or law upon which the original decision was based. The issues raised by the protester were new and were required to independently meet the timeliness criteria. GAO held that the new protest about review solicitation copies was untimely because, although the protester alleged that it originally filed a timely protest with the agency, no evidence was submitted to support its statement. Accordingly, the request for reconsideration was dismissed.
