GAO responded to a congressional request concerning the legality of the Department of Energy's (DOE) grant to Scientists and Engineers for Secure Energy to conduct college campus forums on nuclear energy. Specifically, GAO was asked whether the grant was within the scope of the agency's authority and whether the agency's grant regulations were complied with. GAO concluded that, based on DOE grant authority and regulations, DOE did not have the authority to use a grant instrument in the described circumstances. GAO also noted that conflict-of-interest statutes were not applicable to this grant, and DOE would be obligated for only a portion of the funding if performance levels were not met.
