[Request for Reconsideration of Protest of Navy Cost Comparison]

Reconsideration was requested of a decision in which GAO sustained in part and denied in part a firm's protest of the propriety of a Navy cost comparison that was to determine whether to perform certain services in-house or to contract for them. Subsequent to requesting reconsideration, the protester petitioned a U.S. court for relief, citing the same issues presented in the request for reconsideration. GAO does not reconsider a decision where the material issues are pending before a court of competent jurisdiction unless the court expresses interest in its views. Since the court did not express such interest, the request for reconsideration was dismissed.
