In response to comments on proposed bid protest regulations, GAO adopted a portion of the comments in its new regulations because the suggestion that the Small Business Administration (SBA) make final disposition of contracting officer small business responsibility determinations should be revised to make it clear that the failure of SBA to issue a Certificate of Competency does not preclude the contracting officer from reconsidering a negative decision. However, GAO did not adopt one suggestion because it believed that its continued review of section 8(a) procurements in extremely limited circumstances ensures that procurement regulations are followed and does not harm the program. GAO also failed to adopt another suggestion because it believed that its continued review of protests of decisions to set aside procurements and award contracts under sections 9 and 15 of the Small Business Act are proper and will aid in ensuring that the act is properly implemented.
