Highlights

A firm requested reconsideration of a decision which denied its protest that a bid submitted by another firm was ambiguous regarding the price of certain items. In the prior decision, GAO recognized that the firm had incorrectly completed its bid form, but held that the only reasonable interpretation of the firm's bid was that it included duty in its prices. Even though it had stated that the amount given for import duty was approximate, the bid prices were not ambiguous, because the prices quoted were carried out to four decimal places. Since the remainder of the request for reconsideration was a restatement of arguments made in the original protest and no evidence of any factual or legal error in the decision was given which warranted reconsideration, the prior decision was affirmed.
