Comments on a Draft Segment of an FAR

GAO commented on a draft segment of the Federal Acquisition Regulations dealing with types of contracts. There was concern as to whether the draft segment established guidelines for determining when a waiver of maximum fee is appropriate with cost-plus-incentive-fee and cost-plus-award-fee contracts. GAO determined that the draft segment did not establish such guidelines, but that the regulation should provide some guidance as to when a waiver would be appropriate.
