A firm filed a complaint regarding a 100 percent performance bond requirement in a solicitation issued by an Urban Mass Transportation Administration (UMTA) grantee. The firm had previously complained unsuccessfully to the grantee and UMTA for the deletion of the performance bond and postponement of bid opening. While the firm did not submit a bid, two other firms did. Subsequently, the grantee, with UMTA concurrence, decided to reject both bids and to readvertise at a later date. Under these circumstances, the complaint is academic, and no useful purpose would be served if it were to be considered. Therefore, the complaint was dismissed.
