A former employee of the Federal Aviation Administration (FAA) requested a waiver of his 24-month service agreement with the Government. The employee transferred to Alaska at Government expense and later terminated his employment for reasons that were not acceptable to FAA. The Claims Division agreed with the agency determination and denied the request for waiver. The employee appealed this decision. However, the employee failed to produce evidence to show that the agency action was arbitrary or capricious. The employee also failed to submit any new evidence with his appeal. Accordingly, GAO found no basis upon which to overturn the denial of the waiver of the service agreement by the agency. Therefore, the Claims Division denial of the request was sustained.
