PRECIS-UNAVAILABLE

ABRAHAM RIBICOFF, UNITED STATES SENATE:

YOUR LETTER OF MAY 6, 1980, REQUESTED OUR VIEWS ON S. 2506, A BILL TO AMEND SECTION 3109 OF TITLE 5, U.S.C. TO CLARIFY THE AUTHORITY FOR APPOINTMENT AND COMPENSATION OF EXPERTS AND CONSULTANTS. ON JANUARY 28, 1980, WE PROVIDED THE ENCLOSED COMMENTS TO THE DIRECTOR, OFFICE OF MANAGEMENT AND BUDGET ON AN EARLIER DRAFT OF THIS BILL. IN COMMENTING ON THE DRAFT BILL, WE SUGGESTED CHANGES TO THE DEFINITIONS OF EXPERT AND CONSULTANT AND AN ADDITIONAL PROVISION TO AUTHORIZE THE OFFICE OF PERSONNEL MANAGEMENT TO SUSPEND AN AGENCY'S AUTHORITY TO USE SECTION 3109 IF THE AGENCY DID NOT TAKE THE CORRECTIVE ACTIONS RECOMMENDED BY THE OFFICE. THESE SUGGESTED CHANGES HAVE BEEN INCORPORATED IN S. 2506.

IN ADDITION, WE SUGGESTED THAT AN AMENDMENT BE ADDED TO THE DRAFT BILL THAT WOULD REQUIRE AGENCIES TO REPORT TO THE OFFICE OF PERSONNEL MANAGEMENT AT THE END OF EACH APPOINTMENT THE ACTUAL NUMBER OF DAYS THAT EACH EXPERT OR CONSULTANT WORKED AND THE TOTAL SALARY RECEIVED. THIS AMENDMENT HAS NOT BEEN INCORPORATED IN S. 2506. FOR THE REASONS DISCUSSED IN THE ENCLOSURE, WE CONTINUE TO SUPPORT THE NEED FOR THIS AMENDMENT. NOTWITHSTANDING THE ABSENCE OF THIS AMENDMENT FROM S. 2506, WE BELIEVE THE BILL IS A STEP FORWARD THAT CAN PROVIDE GREATER CONTROL AND UNIFORMITY OVER THE EMPLOYMENT OF EXPERTS AND CONSULTANTS.
