A retired service member requested reconsideration of a Claims Division settlement which disallowed his claim for additional amounts he believed were due to him as a result of action taken by the Coast Guard to correct his military records in promoting him from petty officer to warrant officer. After the member's records had been changed to show that he had been retroactively promoted, he was sent a check which represented the difference between his active duty pay and allowance entitlements for a period of 4 years before his retirement and the difference between his retired pay entitlements after his retirement. An explanation of the method used to recompute his monetary entitlements accompanied the check. Although the member accepted the amount tendered, he later disagreed with the recomputation method. The member questioned the fairness of the Claims Division's conclusions. Legislation provides with respect to the payment of monetary claims of a service member whose records have been corrected, that a claimant's acceptance of a settlement fully satisfies the claim concerned. This bars a pursuit of further claims against the Government incident to the records correction action. It appeared that the member's pay accounts had been properly adjusted, and therefore, the prior decision was sustained.
