REFERENCE IS MADE TO YOUR MEMORANDUM DATED DECEMBER 8, 1979, REQUESTING A DECISION WHETHER MR. EDWARD J. MCLAUGHLIN, AN EMPLOYEE IN OUR INTERNATIONAL DIVISION, MAY BE REIMBURSED FOR COSTS ASSOCIATED WITH THE SHIPMENT OF HIS FOREIGN-MADE VEHICLE TO AND FROM FRANKFURT, GERMANY, INCIDENT TO HIS FOREIGN DUTY ASSIGNMENT.

UNDER THE FEDERAL TRAVEL REGULATIONS (FTR), FPMR 101-7, PARA. 2-10.2C, DATED MAY 1973, WHICH IMPLEMENT THE STATUTORY REQUIREMENTS OF 5 U.S.C. SEC. 5727(B)(2), A PRIVATELY-OWNED VEHICLE MAY BE SHIPPED AT GOVERNMENT EXPENSE IF THE HEAD OF THE DEPARTMENT OR HIS DESIGNEE DETERMINES THAT IT IS IN THE INTEREST OF THE GOVERNMENT FOR THE EMPLOYEE TO HAVE THE USE OF A PRIVATELY-OWNED VEHICLE AT HIS POST OF DUTY OUTSIDE THE CONTERMINOUS UNITED STATES. FURTHER, FTR PARA. 2-10.2C(6)(III) AUTHORIZES REIMBURSEMENT FOR THE SHIPMENT OF A FOREIGN-MADE VEHICLE IF IT IS DETERMINED THAT THE EMPLOYEE SHOULD BE SO ALLOWED.

IT IS OUR UNDERSTANDING THAT IT IS THE POLICY OF THIS OFFICE, ALBEIT UNWRITTEN, TO AUTHORIZE SHIPMENT OF FOREIGN-MADE VEHICLES IN ACCORDANCE WITH FTR PARA. 2-10.2C(6)(III). WE CONCLUDE, THEREFORE, THAT MR. MCLAUGHLIN WAS ENTITLED TO SHIP HIS FOREIGN-MADE VEHICLE TO FRANKFURT AT GOVERNMENT EXPENSE AND THAT HE MAY BE REIMBURSED FOR RETURN SHIPMENT TO THE UNITED STATES.

ALTHOUGH REIMBURSEMENT TO MR. MCLAUGHLIN IS AUTHORIZED ON THE BASIS OF LONGSTANDING UNWRITTEN POLICY, WE NOTE THAT THERE ARE A NUMBER OF REFINEMENTS REGARDING THE SHIPMENT OF FOREIGN VEHICLES WHICH ARE NOT ADDRESSED THROUGH RELIANCE UPON SUCH GENERAL POLICY. WE UNDERSTAND THAT SPECIFIC WRITTEN POLICIES WILL BE DETAILED TO COVER IN THE FUTURE SUCH MATTERS AS DATE OF VEHICLE PURCHASE, REPLACEMENT VEHICLES OVERSEAS, ETC.
