Request for Reconsideration Following Court Adjudication

A firm requested reconsideration of a previous decision in which GAO sustained the National Office Moving Company's protest regarding the Department of State's award of a contract to the firm. Subsequent to filing its request for reconsideration, the firm filed a complaint for declaratory and injunctive relief in the U.S. District Court for the District of Columbia. In its ruling, the court denied the firm's request for a preliminary injunction and dismissed the action. GAO held that the decision of the court in this matter constituted a final adjudication on the merits of the case barring further action by GAO. Accordingly, the request for reconsideration was dismissed.
