A low bidder under solicitation for a Navy contract protested the cancellation of the invitation for bids (IFB). The Navy canceled the IFB because it felt it could not furnish the Government material and equipment required for the contract in a timely manner and also because some of the solicitation specifications would have to be modified. The protester contended that the Navy knew the status of the material and equipment before bid opening and obviously felt that it could be delivered on time. The protester also contended that at the time of the preaward survey, the Navy had indicated that the material needed for the first article phase of the contract would be ready immediately after award, and since the balance was not required until after approval of the first article, the Navy would have had sufficient time to obtain the rest of the material. It was held that while the Navy had demonstrated that two legitimate reasons were present for cancellation, the inability to provide the Government material and the necessity of making material changes in the solicitation, the protester had not provided sufficient evidence contradicting the Navy's position. Therefore, the cancellation was proper and the protest was denied.
