Request for Reconsideration

A firm requested reconsideration of a decision which GAO rendered in response to an expression of interest from the U.S. District Court in connection with a civil action before it. GAO will not decide matters where the material issues are before a court of competent jurisdiction. However, if the court expresses an interest in a GAO decision, the matter will be considered on its merits. In this case, since the prior decision was in response to the court's request and the court has not indicated an interest in a GAO reconsideration, GAO would take no further action on the merits of the matter. Accordingly, the request for reconsideration was dismissed.
