An employee appealed from a denial inpart of his claim for a retroactive temporary promotion and backpay alleging that the early period of his backpay claim from January 1 to September 14, 1974 was ignored, and that he was detailed beyond the period his claim allowed. GAO held that he was not eligible for promotion during that period because he had not satisfied the 1-year-in-grade requirement in applicable legislation. The record showed no evidence of the employee's having performed higher-graded duties after September 25, 1975, and he did not provide such evidence from an official source. Since the employee failed to establish the liability of the Uninted States and his right to payment for the latter period, the prior action was sustained.
