A decision was requested concerning the entitlement of a National Science Foundation (NSF) employee in the NSF competitive service to retroactive temporary promotions for two periods during which he was detailed to a position within the NSF excepted service. With regard to the first detail, the employee was not entitled to the promotion because when appointing or converting an employee from the competitive service to the excepted service the employee must be informed of the nature of the action and submit a written statement to that effect, and this was not done. In addition, the claim was not allowable because it was not filed with GAO within 6 years after the claim accrued as required. A further basis for the disallowance of both claims was that there is only a remedy for details within the excepted service and details within the competitive service under the General Schedule, not for details between the two services.
