Claim for Retroactive Promotion and Backpay

A Department of the Army employee requested reconsideration of the denial of his claim for a retroactive temporary promotion and back pay. The employee was detailed to act as Branch Chief in the absence of the Chief who was a military officer. The employee also stated that the agency failed to follow the Merit Promotion System, referring to a previous grievance which alleged that he was not given proper credit for his experience while detailed and thus was not promoted. The employee was not entitled to a retroactive temporary promotion and backpay because he could not have been temporarily promoted into the military position. Regulations provide that the employee could have appealed for a review of his classification while he was on detail, however, such reclassification can not be made retroactively. The disallowance of the employee's claim was sustained.
