An employee requested reconsideration of his claim for a retroactive temporary promotion with backpay. The GS-12 employee alleged that he was detailed for 3 years to a GS-13 position, a position occupied by his immediate supervisor prior to his reassignment. To support this claim, the employee submitted copies of statements made by his supervisors purporting to show that he performed at the GS-13 level. However, the supervisor and the present and former deputy directors of the agency reevaluated the circumstances of the employee's performance during the period of the claim. This reevaluation was contained in an administrative report which described the duties and responsibilities officially assigned to the employee during the period of the claim. The report concluded that although the employee performed some of the higher graded duties, he performed mostly at the GS-12 level. The evidence submitted by the employee failed to prove that he performed all of the essential duties of the GS-13 position as alleged. Accordingly, the previous decision was sustained.
