A solicitation offeror protested the award of a contract to any contractor other than itself. The protester was granted a permanent injunction in civil court enjoining the agency from making such an award. Such action constituted a final adjudication on the merits with regard to the award of any contract under the instant solicitation. The protest was not for consideration since material issues were the subject of a judicial decision.
