A firm requested that a previously dismissed complaint be reopened and decided. Originally, the protester complained that a county improperly awarded a contract substantially funded by an Environmental Protection Agency (EPA) grant. It protested that the awardee's bid was nonresponsive because the awardee made several technical design errors and the patent imdemnity clause it offered differed from the clause included in the solicitation. After filing an initial protest with the grantee and an unsuccessful appeal to EPA, the protester filed a complaint with GAO and with the United States District Court. The complaint filed with GAO was dismissed because the Court did not seek a GAO opinion in the matter. GAO found little useful purpose in reopening the matter. The protester did not assert any error of law appearing on the face of the EPA decision, and the points of law it raised involved well settled principles. The request was denied.
