A decision was requested concerning the legality of paying Government benefits including a Survivor Benefit Plan annuity to the widow of a retired member whom she had been charged with killing feloniously. Although the conviction had been reversed and there was insufficient evidence for a new trial, benefits may not be paid because the absence of felonious intent was not established.
