A protester to a contract award argued that: the contract should have been terminated because of the awardee's failure to furnish a performance bond within the time period specified in the solicitation, the contracting officer's responsibility determination was either nonexistent or was not in accordance with the contract, and the awardee's poor financial condition would have become apparent if submission of the bond had been required. The affirmative determination of responsibility was not for GAO review under the circumstances of this case. The contractor's failure to furnish a performance bond was a matter of contract administration, and the validity of the award was not questioned. However, in the future, performance bond requirements should be strictly enforced.
