Reformation of Contract May Not Be Granted

Highlights

A company requested reformation of its contract price because of a bid error resulting from its misunderstanding of certain costs at the time of the bid. The contracting officer met his obligation to notify the bidder of a suspected mistake, and although the Government's estimate as set forth in the solicitation was subsequently revised downward, failure to disclose that information to the bidder did not affect the validity of notification of suspected error. Reformation of the contract may not be granted because the error was not so gross as to result in the Government "obviously getting something for nothing."
