GAO was asked to investigate the matter of a former Federal employee who was reinstated at the General Schedule (GS) 5, step 1, grade level by the Department of the Army. The employee had previously worked as a Medical Radiology Technologist, GS-6, and a Receptionist Clerk, GS-3. They believe the GS-5, step 1, salary is too low for their years of experience in Radiology.
GAO has consistently held that upon reemployment, an employee has no vested right to receive the highest salary rate previously paid to him, and determined the fixing of the employee's basic rate of pay by the Department of the Army at the minimum salary of the grade (GS-5) was in accordance with the applicable law and regulation.
