Highlights

The protesters objected to the award of the contract to other than the apparent low bidder. The low bidder who did not have the intrastate operating rights required by the solicitation for performance of the contract was properly found nonresponsible. The Armed Service Procurement Regulations provide that no contract may be awarded to any person or firm unless the contracting officer first makes affirmative determination that the prospective contractor is responsible.
