Consideration of Post-Bid Opening Protest on Merits

Three prospective contractors alleged that the solicitation specifications for food services were ambiguous. Although the protests were untimely filed, the deficiencies in the procurement warranted consideration of the protests on their merits. Since the bids could not be fairly compared and evaluated and since the invitation encouraged unbalanced bidding, the invitation for bids should be cancelled and the requirements resolicited.
