Claim for Pay and Allowances for Incapacitation Due to Injury in the Line of Duty

An advance decision was requested regarding the payment of active duty pay and allowances to a member for incapacitation due to an injury incurred in the line of duty. The member was responsible for keeping military authorities advised of his disability status so that prompt action could be taken to institute disability proceedings or a final determination made disposing of the case within a reasonable time. The member could not, by postponing treatment or examination, extend the period of entitlement to full pay and allowances, thus permitting the continued payment of such compensation when the right thereto had not been clearly established by a showing of the continued disability.
