A protester contended that the low bidder was nonresponsive because it failed to submit a bid bond with its bid and the second low bidder was nonresponsive because it failed to acknowledge an amendment to the solicitation. The low bid was nonresponsive because failure to provide a bid bond, as required by the solicitation, was a material omission that rendered the bid nonresponsive. Since the amendment merely corrected a typographical error, the second low bidder's failure to acknowledge the amendment may be waived, and it may receive the award.
