Request for Reconsideration of Decision That Contract Should Be Terminated for the Convenience of the Government

Reconsideration was requested of a decision which recommended that a contract with the protester be terminated for the convenience of the government. The recommendation for termination for convenience was sustained notwithstanding the contractors' allegation that termination would be costly for the government since such practicalities were considered in arriving at the recommendation. The allegation that there was an appearance of affiliation between the first and third low bidders which jeopardized the integrity of the competitive bidding system was unfounded since no evidence was provided which proved that the bids were not arrived at independently. The contract could not be nullified since the contractor did not contribute to the mistake resulting in the award nor was it on direct notice before award that the procedures being followed were improper.
