A firm objected to an award of a contract, alleging that the awardee was nonresponsive for failure to acknowledge an amendment to the invitation for bids. Failure to acknowledge the amendment incorporating the revised Davis-Bacon wage determination in the invitation rendered the bid nonresponsive and the subsequent award improper. The failure to acknowledge the amendment was not for waiver as a minor informality or irregularity since the amendment affected price, and the acceptance of the low bid was prejudicial to other bidders. However, termination of the improperly awarded contract for the convenience of the government was not economically feasible since the contract was largely completed.
