Request for Contract Adjustment Based on Error Alleged After Award

B-182895 May 29, 1975

Highlights

The contractor requested a modification of its contract to reflect a price increase based on an allegation of a unilateral mistake in its offer. There was no basis for contract adjustment since the contracting officer adequately discharged his verification duty by calling to the offerer's attention the fact that its offered price appeared to be unreasonably low and since the contractor subsequently verified the offer. The agency should provide procedures to be followed when a mistake is suspected before an award in a negotiated procurement.
