The protester filed protests with regard to three requests for proposals, alleging that the approval of a second company as an alternate source for the procured item could only have been accomplished through the Government's misuse and indirect disclosure of data proprietary to the protester. Subsequent to filing the protests with GAO, the protester filed suit with a U.S. District Court and later filed notice of appeal of that court's denial of a preliminary injunction. The protests were dismissed since GAO does not render decisions on issues which are pending before a court of competent jurisdiction.
