Waiver of Erroneous Annuity Payments Received

The agency recommended waiver of recovery of annuity payments erroneously paid to the widow of Lloyd Gibson. The overpayment made under section 4 of Public Law 92-425 which provided a minimum income guarantee for certain widows of former retired military members was not for consideration for waiver under 10 U.S.C. 1453, as recommended by the agency. However, the collection action on the overpayment could properly be terminated in accordance with the provisions of the Federal Claims Collection Act of 1966.
