ALTHOUGH PROTEST BY NATIONAL STEEL AND SHIPBUILDING COMPANY AGAINST AWARD TO ANOTHER FIRM UNDER IFB NO. N62791-73-B-0549 ISSUED BY 11TH NAVAL DISTRICT, SAN DIEGO, CALIFORNIA WAS DENIED, ONE OF THE APPLICABLE CLAUSES OF ASPR 1-305.3(B) SHOULD HAVE BEEN USED IN THE IFB.

ENCLOSED IS A COPY OF OUR DECISION OF TODAY TO NATIONAL STEEL AND SHIPBUILDING COMPANY DENYING ITS PROTEST AGAINST AWARD OF A CONTRACT TO TRIPLE A MACHINE SHOP, INC., UNDER INVITATION FOR BIDS N62791-73-B 0549.

WHILE FOR THE REASONS STATED WE HAD NO LEGAL OBJECTIONS TO THE ACTIONS TAKEN, YOUR ATTENTION IS DIRECTED TO THAT PORTION OF THE DECISION WHICH FOUND THAT ONE OF THE APPLICABLE CLAUSES OF ASPR 1 305.3(B) SHOULD HAVE BEEN USED.
