REFERENCE IS MADE TO YOUR LETTER OF FEBRUARY 14, 1973, REQUESTING OUR ADVICE AS TO PAYMENT OF A VOUCHER IN THE AMOUNT OF $53.58 SUBMITTED BY MR. JOSEPH H. TRIMBACH FOR REIMBURSEMENT OF MISCELLANEOUS EXPENSES ALLEGEDLY INCURRED BY HIM AS A RESULT OF HIS OFFICIAL CHANGE OF STATION FROM CLEVELAND, OHIO, TO WASHINGTON, D.C.

MR. TRIMBACH PREVIOUSLY HAD CLAIMED AND WAS PAID $200 AS A MISCELLANEOUS ALLOWANCE PURSUANT TO SECTION 3.3A(2) OF OFFICE OF MANAGEMENT AND BUDGET (OMB) CIRCULAR NO. A-56. HE NOW CLAIMS THE ADDITIONAL AMOUNT UNDER SECTION 3.3(B) OF THAT SAME CIRCULAR ALLEGING TOTAL EXPENSES ABOVE $200 BUT LESS THAN THE MAXIMUM ALLOWED BY THAT SECTION. THE ADDITIONAL AMOUNT CLAIMED RESULTS FROM INCLUDING HIS COSTS FOR A VIRGINIA APPROVED DRIVER'S EDUCATION COURSE FOR HIS SON (DANIEL) THEN AGE 16-1/2, AS PART OF THE MISCELLANEOUS EXPENSES HE INCURRED AS THE RESULT OF HIS CHANGE OF STATION.

THE DRIVER'S COURSE WAS TAKEN TO ENABLE DANIEL, ALREADY A LICENSED DRIVER IN OHIO, TO OBTAIN A VIRGINIA DRIVER'S LICENSE SINCE VIRGINIA REFUSED TO RECOGNIZE THE STATE OF OHIO DRIVER'S EDUCATION COURSE ALREADY COMPLETED BY HIM. VIRGINIA, LIKE OHIO, REQUIRES THAT A PERSON UNDER 18 ATTEND A STATE- APPROVED COURSE OF DRIVER EDUCATION BEFORE BEING ISSUED AN OPERATOR'S LICENSE.

SECTION 3.1B OF CIRCULAR NO. A-56, CONCERNING THE MISCELLANEOUS EXPENSE IS AS FOLLOWS:

B. TYPES OF COSTS COVERED. THE ALLOWANCE IS RELATED TO EXPENSES THAT ARE COMMON TO LIVING QUARTERS FURNISHINGS AND HOUSEHOLD APPLIANCES AND TO OTHER GENERAL TYPES OF COSTS INHERENT IN RELOCATION OF A PLACE OF RESIDENCE. THE TYPES OF COSTS INTENDED TO BE REIMBURSED UNDER THE ALLOWANCE INCLUDE, BUT ARE NOT LIMITED TO, THE FOLLOWING:

(1) DISCONNECTING AND CONNECTING APPLIANCES, EQUIPMENT AND UTILITIES INVOLVED IN RELOCATION, AND COST OF CONVERTING APPLIANCES FOR OPERATION ON AVAILABLE UTILITIES.

(2) UNBLOCKING, BLOCKING AND RELATED EXPENSES IN CONNECTION WITH RELOCATING A MOBILE HOME, BUT NOT THE TRANSPORTATION EXPENSES ALLOWED UNDER 9.3.

(3) CUTTING AND FITTING RUGS, DRAPERIES AND CURTAINS MOVED FROM ONE RESIDENCE QUARTERS TO ANOTHER.

(4) UTILITY FEES OR DEPOSITS THAT ARE NOT OFFSET BY EVENTUAL REFUNDS.

(5) FORFEITURE LOSSES ON MEDICAL, DENTAL, AND FOOD LOCKER CONTRACTS THAT ARE NOT TRANSFERABLE.

(6) AUTOMOBILE REGISTRATION, DRIVER'S LICENSE, AND USE TAXES IMPOSED WHEN BRINGING AUTOMOBILES INTO SOME JURISDICTIONS.

WHILE SECTION 3.1B(6) LISTS ONLY "DRIVER'S LICENSE," NO MENTION IS MADE OF ANY "EXPENSES NECESSARY IN OBTAINING A DRIVER'S LICENSE." HOWEVER, AT THE BEGINNING OF THAT SECTION IT IS INDICATED THAT THE TYPE OF COSTS WHICH MAY BE REIMBURSED UNDER THE MISCELLANEOUS EXPENSE ALLOWANCE IS NOT LIMITED TO THOSE LISTED THEREIN.

SINCE IN THIS CASE THE SON WAS ALREADY LICENSED TO DRIVE A MOTOR VEHICLE IN THE STATE OF OHIO THE EXPENSES INCURRED IN ATTENDING A DRIVER'S COURSE IN VIRGINIA MAY BE REGARDED AS A PART OF THE COST OF OBTAINING A NEW DRIVER'S LICENSE WHICH WAS DIRECTLY RELATED TO THE TRANSFER OF THE EMPLOYEE'S OFFICIAL STATION.

THE VOUCHER FOR $53.58 IS RETURNED HEREWITH AND MAY BE CERTIFIED FOR PAYMENT IF OTHERWISE CORRECT.
