THIS AMOUNT REPRESENTS THOSE LIQUIDATED DAMAGES WHICH WERE ASSESSED AFTER THE GOVERNMENT APPROVED AN EXTENSION OF THE DELIVERY SCHEDULE SUBJECT TO RECEIPT OF ADEQUATE CONSIDERATION.

CONTRACT - REMISSION OF LIQUIDATED DAMAGES DECISION ALLOWING PARTIAL REMISSION OF LIQUIDATED DAMAGES ASSESSED AGAINST ACME INDUSTRIES, INC., AS A RESULT OF LATE DELIVERY UNDER A CONTRACT WITH THE NAVY. UNDER THE AUTHORITY OF 10 U.S.C. 2312, REMISSION IS ALLOWED FOR THAT AMOUNT REPRESENTING THOSE LIQUIDATED DAMAGES ASSESSED AFTER THE GOVERNMENT APPROVED AN EXTENSION OF THE DELIVERY SCHEDULE SUBJECT TO RECEIPT OF ADEQUATE CONSIDERATION.

TO MR. SECRETARY:

REFERENCE IS MADE TO A LETTER OF DECEMBER 20, 1972, WITH ENCLOSURES, FROM THE ASSISTANT SECRETARY, REGARDING THE PARTIAL REMISSION OF LIQUIDATED DAMAGES AGAINST ACME INDUSTRIES, INCORPORATED. DAMAGES IN THE AMOUNT OF $19,440 WERE ASSESSED AS A RESULT OF LATE DELIVERY UNDER CONTRACT N00019- 69-C-0532 FOR THE MANUFACTURE AND SUPPLY OF 40 MODEL NR 5C MOBILE AIR CONDITIONING UNITS TO BE USED ON NAVY CARRIERS AND SHORE INSTALLATIONS IN SUPPORT OF E-2A AND P-3C AIRCRAFT.

BY VIRTUE OF THE AUTHORITY VESTED IN ME BY 10 U.S.C. 2312, AND IN ACCORDANCE WITH THE RECOMMENDATION OF THE ASSISTANT SECRETARY, I HEREBY APPROVE PARTIAL REMISSION OF THE LIQUIDATED DAMAGES TO THE EXTENT OF $17,180. THIS AMOUNT REPRESENTS THOSE LIQUIDATED DAMAGES WHICH WERE ASSESSED AFTER THE GOVERNMENT APPROVED AN EXTENSION OF THE DELIVERY SCHEDULE SUBJECT TO RECEIPT OF ADEQUATE CONSIDERATION, LESS $300 AS CONSIDERATION.
